    Des Moines contract sales inspection laws designed to combat installmetn fraud

    On October 7, 2002 the  Des Moines City Council passed the Real Estate Installment Contract Sales Inspection Ordinance with much fanfare. In a nut shell, it requires contact sellers of property located in Des Moines and Windsor Heights to provide a written inspection report to buyers who purchase by land or installment contract. The are a few exceptions of course, some transfers exempt from the ordinance include those made pursuant to a court order, eminent domain, foreclosure or deed in lieu thereof, forfeiture, between joint owners, spouses, parents or descendants, involving a government or by quit claim deed. Ordinance 14,205 became fully effective January 1, 2003.

     So now any person seeking to sell residential real estate by installment-land contract is required to have an inspector who is certified by the city personally inspect the property and then provide the buyer with the written inspection report describing the inspection. The inspection at a minimum needs to include a review of the structural components, exterior, roofing, plumbing, heating, cooling, electrical, insulation and ventilation, interior, fireplace and solid fuel burning appliances. The report then must be on a form approved by the City Neighborhood Inspection Division [NID]. The inspection report costs about $120 to produce and is valid for 60 days. Ina twist, to be eligible an inspector must be a member in good standing of a non-profit, professional association for home inspectors in order to be approved by the NID and the inspector cannot work for the seller.

     To make sure the seller complies, the report must be given to the buyer at least fourteen days before the transfer to the proposed buyer and the seller must file then the inspection report with the NID. After that hurdle and within seven days after the transfer, the seller has to file a signed copy of the Installment Purchase Contract with the NID and pay an additional administrative fee of $75.

     If a seller does not  comply with the ordinance it is considered a municipal infraction punishable by a civil penalty of up to $500.00 for each violation or, if the infraction is a repeat offense, by a civil penalty of not more than $750.00 for each occurance. The new rule provides all installment-land contract purchasers with extensive additional information regarding the physical condition of the property that is being purchased. In addition, the ordinance will slow down the transaction process to allow the prospective purchaser a minimum of fourteen days to talk to contractors, relatives and anyone else about necessary repairs prior to purchasing the home.

     Furthermore, as of July 1, 2002, state law HF 2565 added further requirements, for sales of residential real estate on an installment contract basis. Specifically if a seller makes four or more installment contract sales of residential real estate in a year, considerably greater information must be provided to the contract buyer before the sale.

     The law came about because between 1998 and the year 2000, Des Moines had an estimated 3,336 unregulated real-estate contract sales. The city considered appx. 25% of the homes involved to be in below normal, poor, or very poor conditions. In a few especially egregious cases, unethical contract sales companies sold properties which were condemned and slated for demolition. The most famous among these companies being the Wolford Group, whose owners Rod Wolford Sr and Jr were indicted for fraud related to installment contract sales by the attorney general in the spring of 2003. Wolford Sr. was convicted on 17 counts of fraud and was sentenced to 75 years in prison.Rod Wolford, Jr., pled guilty to two counts of theft in the first degree and one count of securities fraud, and was given a suspended sentence. In 2006 the attorney general ordered over $3 million in civil penalties, restitution, and fees for investigation and attorney costs for the Wolford's many victims.

     Iowa Citizens for Community Improvement, or CCI were instrumental in bringing pressure on the BBB to first revoke the Wolford's affiliation, direct media attention to their activities and expose their practices in order to get the attorney general to indict the men.The CCI estimates that with the passing of the Ordinance and the indictment and conviction of the Wolford's predatory contract sales have all but been eliminated in the Des Moines area.

    A 3 Way In Phoenix!

    Have you ever wondered about having a relationship with 3 people or more at a time? 

    Last week in Phoenix we had a meeting of three woman to create a networking relationship in business at a local Starbucks location.  The event turned into a connection of possibly six different opportunities to help one another.  The goal with the meeting was to determine how we could promote each others business by creating marketing events which would be fun, exciting and mutually beneficial in the future.

    Social Media is the current marketing vehicle to meet new people.  If the relationship is never taken off line it is really might not ever be financially productive.  This is the stumbling point for many observers just watching social media.  There has to be a "call to action" and an appointment set to work the new opportunities and possibly create future cash flow from the new connection.  Social Media is a marathon, not a sprint.  It is going to take some nurturing just like a relationship created at a Chamber of Commerce meeting, there is NO difference in how the relationships grows, it just starts online.

    In real estate anyone over the age of 18 is a possible prospect to buy or sell real estate. Adding to your sphere of influence should be a goal and might possibly include 100 new social media contacts a week.  If you break that down to five days, it is only 20 new friends or followers a day. Easy to do once you are set up in cyberspace.

    Prospecting still needs to be done eyeball to eyeball.  To create new business today, you must be where the eyeballs are. If the eyeballs are on the Internet then you have to be on the Internet and participating where the people are engaging. Think about this, if you are not there, someone in your industry will be, so bringing your A game to the screen will help secure new referral relationships.  In any sales you still need to see the people, see the people, see the people.  You can now start online and then take the relationship off line to really connect. Now it is easier to start on line knowing who the people are by reading their profile.

    It's ok to watch social media for awhile to see how the game is played but at some point you need to jump in and participate and not be afraid to make some mistakes.  Guaranteed, you will make some mistakes so just get over it as you learn.  You will learn how it feels when someone makes a comment that could hurt your feelings... then if you are smart, you will never make another person feel that way yourself.  You will learn my doing and it takes genuine engagement to learn those lessons. 

    How did our 3 way develop?

    1. It all started on linkedin.  I updated my status with a link to an article which was published in the more.com magazine.  Anna Banana is in the same CRS (Certified Real Estate Specialist) group I am in and saw the update.  She then saw the same link on facebook and thought she should connect with me when she determined that I had a Real Estate license and she had seen the article online two times in two different places.
    2. Anna Banana invited me to join activerain and since I had seen several of my Realtor facebook friends posting on their activerain blog, I thought it was time I did too. Anna continued with the engagement and posted about an activerain event in Phoenix and I thought I should come and see first hand what it was about. I started engaging with people who were commenting on my posts and met two wonderful people, one from Lake Havasu City and one from California.  We all met physically at the activerain event and went to lunch after the program with Second Self Virtual Assistance, Heather Chavez and owner, Pamela Cendejas. We now feel part of the activerain family... even sending get well posts to friends across the country recovering from surgery! Because of our activerain meeting in real time, Heather is coming to my house over Thanksgiving after driving in from California to see family in Prescott, AZ.  Pamela and I are going to have lunch with another activerain friend, Candice Donofrio in December and share a girls Spa Day.... the cyber connections are turning into friendships and will eventually result in cash flow.  Candice is working with a referral I sent on a commercial building in Ft. Mohave, AZ so a payday could be coming soon.  It is all because of the activerain connection and personal engagement.
    3. Marcia Fine answered a discussion question I posted in linkedin and we connected.  I was trying to figure out how linkedin worked and how people were using it so I posted a question in a Writers group to connect with people from different backgrounds. I asked.....How is linkedin working for you and would you like to talk about it on a blogtalkradio show.  Marcia responded that she was trying to figure out how it all connected but wanted to be on the blogtalkradioshow.  She had just finished a book and it was ready to launch. The title is "Stressed in Scottsdale".  I talked to her and felt that many people would have the same questions about the journey to connect on linkedin and it would be fun talking about her book and how she was using social media to promote it.
    4. After being on the  program and helping Marcia with some social media ideas she invited me to her book launch party in Phoenix.  Since I was coming to Phoenix I contacted Anna Banana and asked if she wanted to connect with a local Scottsdale, Author and she said "yes."  I felt there could be some great connections with events featuring an Author and giving some spice to different real estate marketing events.
    5. The video above memorializes our meeting and shows just how easy it is to turn cyber freinds into business referral networks.  Anna posted a WCR (Women's Council of Realtors) luncheon on her blog the same day I was going to be in Phoenix so we went to that event and cheered her on at yet a third event for activerain and Realtors in the Scottsdale area on the same day.  We made a video in the class which we posted in class and had instant comments on the post by sending an IM (Instant Message) to activerain friends on facebook asking them to comment and show the newbies how the process worked. 
    6. I posted my adventures on facebook and an activerain friend, Joeann Fossland, National Speaker, trainer and coach asked on my facebook if I was going to be in Phoenix as she was teaching there during the same time. Joanne is an activerain member and we had never met face to face so we made a plan to meet for dinner and connect in real time.  We had a great time and created a video laughing and having a fun discussion about farmville!  At the end of the day, I met four people from social media sites I had been virtually engaging with in real time and we all have a new respect for one another and are looking for ways to help promote each other. For icing on the cake,  I met and got cards from six other individuals as a result of attending the book launch for my linkedin friend, Marcia Fine.  I was asked by one of her friends to speak at her book club so the social media circle expands to real time connections.
    7. I attended the book launch in Scottsdale and one of Marcia's friends, Susan Brooks who owns "Serves You Right" and also a linkedin member asked me about Anna and the Womens Council of Realtors.  Susan is participating in a trip this February to China to help women in China and wanted to talk to someone in WCR about the project.  I have now connected Anna Banana to one of Marcia Fine's friends in linkedin and the networking chain continues.

    If you have been on the fence about how social media is going to help you make money, I hope the summary of the 3 way, which has evolved into at least 6 connections... helps you understand that it takes time to develop relationships.  Social Media gives you a starting point but you have to take it off line and MEET UP in real time to take your networking to the next level.

    Connecting on facebook, linkedin and Twitter are the perfect places to start prospecting!

    Selling your home during the "holidaze;" price it right then do and don't...

    With the holiday season right around the corner many sellers are wondering if they should keep their home on the market or wait for brighter days. Before I get into that here's a great video to get you in the mood.

    Now back to the business of selling your home during the crazy holiday season.  Rule number one, ensure you have the right price.  It's important to ensure you are priced to move in the next 30 days.  Next to get your home sold in this environment you can't just be competitive you must be compelling.  In The Seattle Times published a great article by Lisa Pemberton-Butler it outlines Do's & Don'ts of holiday home sales.

    To get your home sold during the holidays DO:

    • Keep your home warm, if you have a fireplace gas or wood, keep it going.
    • Keep the home well lit, put up Christmas lights just don't go too crazy.
    • Be accommodating, this will separate you from many other home sellers during the holiday season.

    To get your home sold during the holidays DON'T:

    • Overdo holiday decor. A nice holiday wreath on the door or a modest tree would be perfect.
    • Go overboard with holiday aromas. Less is more.
    • Be a "Scroodge" be realistic with the price your expected to get for your home.
    In conclusion, remember you can sell your home during the Holidaze.  Just remember to price it right and remember your dos and don'ts.

    Are you wondering if this is one of those trick questions you hated in school? Maybe you're thinking you only have to sell a home once. 

    This is not the case in today's Orange County real estate market.

    With many homes being distressed and short sales (meaning people owe more on their home than they are worth), it means a house may have to be sold many times before it is sold.

    In a typical sale, the home must be "sold" to three people.

    1. The seller of the home - when they agree to the listing price and/or accept the buyer's offer.
    2. The buyer who offers to buy the home.
    3. The appraiser - who verifies value for the bank.

    I love averages, I sell by comparing averages, I guess that makes me average.

    Are you stuck with a buyer or seller who can't get off the fence?

    I like averages...they have served me well over the years. Averages can be used as guidance with out committing to any guarantees. So...You see Mr. & Mrs. Buyer: The average asking price of a , average size home that sold was $234,822 in this town over the last 12 months. The Average selling price is $216,100, this means on Average the sellers are getting 92% of their asking price at this time.

    What does this do for you? Its a non-committal - committal, These are guidelines, they show a pattern..but do not guarantee 100% success. Your offer will be much more likely to succeed when you look at the averages.

    What should we offer? Based on the market value numbers, you will not be offending the seller at a 90% offer. If the listing agent is doing their job this offer will not be rejected...outright. It will be compared to the other recent sales, and you are likely to have an outright acceptance or a counter offer...in either case you can move forward with out starting all over again.

    What if we went lower...with our offer? The great thing about averages is there are highs and lows in the field, so here again your client can decide how low to go...but they have been cautioned about alienating the seller who may be offended enough not to...counter...or even want this buyer to own their home. This can be a deeply personal decision...wrought with emotion, and I have seen sellers discard not only the offer but any desire to see this buyer, purchase their home.

    Where else can I successfully apply averages to help determine values? Every home is different, but if you narrow down the closed sales search criteria enough and do this for several consecutive years patterns will emerge. You can't lump all land sales together and get meaningful data, but if you search by price per acre...for a six month period and repeat that process for each of the past 6- six month periods (3 years) you can say with some confidence what the values have been for each 43,560 square feet of land in the past 6 consecutive intervals. The same math can be applied to condominiums searched, in a very narrow range of square footage...all with the same number of bedrooms and baths (you will get a pattern). Homes are more difficult with so many different contributing facts that can affect values, but price per square foot can still be broadly applied to give a buyer or seller an expectancy range.

    Do you want to sell more real estate? Get your buyer off the fence with good research and simple math. Remove the hesitation, buyers want to know they are making an informed decision...Show them the money!!

    What does the CMA...tell me? The Condominiums in Lincoln New Hampshire that were 3 bedrooms 2 baths, between 1,200 - 1,600 square feet sold in the last year. Were an average of: 1,420 square feet, an asking price of $237,100 and sold for $224,742...and were on for an average of 207 days. This is a 94.78% sales to asking price ratio...So is my 70% offer going to fly?   I very much doubt it!!

    So -- Just How Smart Is Your Pet?

    Pets can be amazing.  They are often much smarter than we expect.  My cat Yazmine, in my opinion, is extremely intelligent.  And the other day, she really outsmarted me.

    Yaz loves to sit in my chair.  If I am there, I let her sit on my lap, but I can tell that she would love to curl up in the chair alone sometimes.  She also likes to curl up in a cupboard about six feet from the chair.  Although she can open the door to the cupboard, she prefers to bang it a couple of times so that I will open it for her.

    This particular time she looked at my chair and I knew that she wanted to curl up in it. Then she walked over to the cupboard and tied to open it -- half-heartedly -- she knew that I would help.  So I got up, walked over and opened the door.  But -- no cat.  I turned around and she had raced to my chair and was all curled up in it.  She looked at me and I knew that she was thinking,  "I just outsmarted You!"

    I just upgraded to rain maker and started my outside blog but I can't get my domain name. I read the directions and entered in my name but it says not available.

    Shop Locally-Owned Cincinnati Businesses

    A remarkable initiative is underway.  "Break the Chain" is a brainstorm of an organization of locally-owned stores supporting one another, called Buy Cincy.  They are urging you to Break the Chain of the corporate chain stores and shop locally-only for one day.  The third annual celebration of Cincinnati Unchained is Saturday November 21st.  Over 30 stores are participating. 

    All the stores appear to be offering specials of some sort, from a percentage off on certain items to gift certificates to donations to non-profits to samples and more.

    First-time home buyers reached the highest market share on record during the past year, according to the latest consumer survey of home buyers and sellers, by the National Association of Realtors®

    Included in the article are a number of tidbits, including:

    1. The number of 1st time buyers rose to 47%, the highest on record dating back to 1981

    2.  The median age was 30 and the median income $61,600. The typical home cost $156,000, down from $165,000 in the 2008 study

    3.  55% used FHA, while 8% used VA

    When You and Your Family are Going on a Trip, Saftey Tips, with the Holidays apon us, some folks might be planning on visiting relatives and or friends, for a day or two, and in some cases even longer. You sure don't want to come back home, to find it has been broken into. So before you and your family pack up the car or your trusty pack mule. Please be certain that your home is and will be protected. A bit of advanced preparation on your part, sure can help protect your little ole homestead while your gone.

    If your going to be away, for longer than a day or two:

    Be sure to stop mail and newspaper deliveries, or ask a neighbor or friend to pick up your mail and newspaper daily.

    Look all your windows and doors, including your basement and garage doors.

    Leave your blinds or shades in the positions, you would usually have them. This will give your home a normal, folks are home look.

    When You and Your Family are Going on a Trip, Safety Tips, be sure to tell a trusted neighbor when you and your family will be leaving, and when y'all will be returning date. Also supply your neighbor with phone numbers in case of an emergency and leave them a key to your home.

    Let your local police department or if live out in the country, then let the Sheriff's department know, and ask either one of these departments, to periodically stop by to check your residence.

    Be sure not to put a, your out of town message on your home answering machine, voicemail, or in your personal e-mail account.

    If your home has a alarm system, let the alarm company konw you and your family are going to be gone, and ask them to perform routine maintenance on your home's alarm system prior to y'all leaving.

    You Think Your House is Worth WHAT? Pricing Your Home to Sell

    O.k., so you've looked on the Internet, you've checked the Real Estate Weekly - and you've talked to your Neighbors.  You're pretty sure you know what you WANT your home to be worth.  Next step?  You call the Realtors in.

    Everyone says you should interview 3 Realtors - so that's what you do!  And sceptically you await their Verdicts!  Does the highest Bid (because that's what it often is)  win your Vote?  Well it shouldn't and let me tell you why.

                                                      BUT Your neighbor's house just sold for XXXXX!

     

    First of all, Realtors have access to the same information Online.  By doing a CMA (Comparative Market Analysis) they should be able to come very close to the Range of Your Home's Value.  They will see which homes are currently Listed, those that will be in direct competition with Your Home; they will see which comparable homes have Sold recently; and they will ALSO see which homes have 'Expired'....(Listed But Not Sold). That's the Starting Point!

    If you use a Local Realtor - which is what I Recommend- they'll also be able to take into consideration different factors about your neighborhood - like development, schools, safety, proximity to transport etc.     

                                                                BUT Your House has been upgraded!

                                                                     

    Now where no 2 homes are exactly alike - chances are we've seen most of the homes for sale in your area and have an inside view that you may not have seen.  Even online photos won't give you a complete view of how these homes compare. 

    In many ways - it's the Buyer that ultimately determines the value of your home. A house is worth what somebody will pay for it.  It's important to try and anticipate what MOST buyers will pay for it. If the price is too high - you may just end up remaining THAT Buyer!  If your home should by some chance sell for more then the estimated value, remember the home still needs to be Appraised for the Buyer's Bank, and if it's overpriced it just may not!

                                          BUT That's What INEEEEEEEED to Get for My Home!

    There is the odd time that a home is unusual and there are not direct comparables, sometimes this requires a trial and error strategy where we have to gage potential buyer responses in order to fine tune the price. 

    Another factor is the current 'Real Estate market'.  Is it a  Buyer's market or a Seller's market - or is it balanced? What kind of standing inventory is in the market in your price range. These will all factor in to your pricing.

    The value of a home can also be estimated in part by using the price per square foot calculation.  But you do have to use a sliding scale of adjustment.  The 'core' of the home is worth more then the peripheral square footage. ie. the price per sq. foot for a 1000 sq. foot rancher will be higher then that of a 3000 sq. ft. basement home. 

    Should you start higher - after all - you can always come down??? No! If you do that you should be charging your competitor a fee for helping them sell THEIR home!

    Remember the most critical time for selling your home is in the first 30 days.  Longer then that you can bet your bottom dollar, (and unfortunately that's probably what it will end up being) that the Buyer will be paying attention to your 'days on market' when making both their buying decision and price point! 

    How do you know if your house is priced right?  Feedback! Your Realtor will be calling to get feedback on showings from both the Buyer and their Realtor.  If you've had over 6 showings and have been on the market for 3 or so weeks  that should give you some idea of what the market thinks.  Unusual or high end homes could be the exception here though. 

    Sometimes the most important factor is YOUR motivation. How motivated are you to sell?   I know a lot of Seller's like to tell us that 'they don't HAVE to sell'.......and in most cases that's true - you don't!  But if you do want to sell your home call a Realtor that knows your market and will be honest with you - because that's what a professional does - they Help you Price Your Home to Sell!
